LEGAL NOTICE SECTION 00020 ADVERTISEMENT FOR BIDS AMI WATER METER INSTALLATION CONTRACT In accordance with Act 97-225 (the Alabama Public Works Act), notice is hereby given that the Limestone County Water and Sewer Authority (Awarding Authority) will receive competitive bids, under seal, from Contractors licensed in the State of Alabama to fabricate and install the project. Sealed proposals will be received by the Limestone County Water and Sewer Authority at their office located at 17218 Highway 72 West, Athens, Alabama 35611 until 11:00 am local time, June 30, 2016. At that time, the bids will be opened in public and evaluated by the Engineer for administrative and technical completeness. The bids will then be presented to the Limestone County Water and Sewer Authority Board of Directors and General Manager for final consideration. Bidding proposals should be addressed to Mr. Byron Cook, General Manager, in sealed packages with the words AMI WATER METER INSTALLATION CONTRACT appearing on the outside of the envelope or package. All appropriate licensing information shall be provided on the face of the bid envelope. All proposals must be accompanied by either a cashier's check drawn on an Alabama bank or a Bid Bond executed by a surety company, duly authorized and qualified to make such bonds in the State of Alabama, in an amount not less than five percent (5%) of the proposed capital cost submitted. Any disclosure in advance of the terms of a bid in response to this invitation shall render the proceedings void and require advertisement and award anew. The award shall be made to the lowest responsible and responsive Bidder, unless the Awarding Authority finds that all of the bids are unreasonable or that it is not in the interest of the Awarding Authority to accept any of the bids. A responsible Bidder is one, who among other qualities determined necessary for performance, is competent, experienced, and financially able to perform the Contract. A responsive bidder is one who submits a bid that complies with the terms and conditions of this Invitation to Bid and the Contract Documents. All applicable tax must be included in the bid price. The Contractor who is awarded the Contract must comply with provisions of the Alabama Public Works Act. According to the Alabama Public Works Act, the Awarding Authority shall give preference to resident bidders. A nonresident bidder shall be awarded Alabama public contracts only on the same basis as the nonresident bidder's state awards contracts to Alabama bidders under similar circumstances. Nonresident bidders must accompany any written Bid Documents with a written opinion of an attorney-at-law licensed to practice in such nonresident bidder's state of domicile, as to the preferences, if any or none, granted by the law of that state to its own resident businesses in the letting of any or all public contracts. The Awarding Authority shall also stipulate or cause to be stipulated in the Contract a provision whereby the person, firm or corporation undertaking the project agrees to use in the execution of the contract materials, supplies, and products manufactured, mined, processed, or otherwise produced in the United States or its territories, if the same are available at reasonable and competitive prices. In the event that the entity awarded the Contract violates the agreement to use domestic products, then there shall be a downward adjustment in the Contract price equal to any realized savings or benefits to the Contractor. Bidder's Proposals for the Work shall remain firm for a period of sixty (60) calendar days from the date of the Bid Opening. The Contract Documents, which contain instructions for the submission of Bids, a proposed Contract, and the Specifications for the AMI WATER METER INSTALLATION CONTRACT, is on file for inspection at the Limestone County Water and Sewer Authority's main office, located at 17218 Highway 72 West, Athens, Alabama 35611. Contract Documents may be obtained at the office of Hethcoat & Davis, Inc. located at 278 Franklin Road, Suite 200, Brentwood, Tennessee 37027; (615) 577-4300. The Authority reserves the right to waive minor informalities, irregularities, and errors. Any item bid that is not in expressed conformance with the bid specifications but is offered as a substitute and comparable item, must be submitted in detail.
