FORECLOSURE NOTICE Default having been made in the payment of the indebtedness described in and secured by that certain mortgage executed by CEDRIC M NIX A/K/A CEDRIC MONTE NIX AND DEBRA THOMPSON NIX, husband and wife, as Mortgagor(s) to Mortgage Electronic Registration Systems, Inc., acting solely as nominee for Countrywide Home Loans, Inc. , as Mortgagee, dated the 9th day of September, 2005, and recorded in Book 2005, Page 58909, et seq. of the records in the Office of the Judge of Probate Court of Limestone County, Alabama; said mortgage being lastly assigned to THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWALT, INC., ALTERNATIVE LOAN TRUST 2005-49CB, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-49CB by instrument recorded in said Probate Court records; said default continuing, notice is hereby given that the under-signed will, under and by virtue of the power of sale contained in said mortgage sell at public outcry for cash to the highest bidder during legal hours of sale, on the 24th day of March, 2016, in the city of Athens, at the Front Door of the Court House of Limestone County, Alabama, the following described real property situated in the County of Limestone, State of Alabama, to-wit: LOT 25, BLOCK 1, ACCORDING TO THE PLAT OF ROCK CREEK, PHASE 2, AS RECORDED IN INSTRUMENT NO. G PAGES 223 AND 224, IN THE OFFICE OF THE JUDGE OF PROBATE OF LIMESTONE COUNTY, ALABAMA THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, RESERVATIONS AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND/OR THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED.
