NOTICE OF MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by CLINTON E. DOWNS, an unmarried man, on the 29th day of July 2011, to VANDERBILT MORTGAGE AND FINANCE, INC., as recorded in RLPY Book 2011, Page 37718, in the office of the Probate Judge of Limestone County, Alabama; VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given, that acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Athens, Limestone County, Alabama, during the legal hours of sale on February 6, 2018, the following described real and personal property situated in Limestone County, Alabama, to-wit: All that part of the South half of Section 6, Township 2 South, Range 5 West, Limestone County, Alabama, particularly described as beginning at a point in an existing gravel road, said point is further described as being located South 89 degrees 56 minutes 21 seconds West 1936.08 feet; North 10 degrees 34 minutes 45 seconds West 56.49 feet; North 89 degrees 39 minutes 13 seconds West 1381.52 feet; North 88 degrees 38 minutes 21 seconds West 670.66 feet; North 00 degrees 21 minutes 22 seconds East 1046.37 feet; South 88 degrees 38 minutes 21 seconds East 1023.73 feet; North 41 degrees 45 minutes 11 seconds West 78.98 feet; North 13 degrees 22 minutes 36 seconds West 150.17 feet; North 43 degrees 19 minutes 31 seconds West 217.71 feet; North 40 degrees 26 minutes 34 seconds West 129.27 feet and North 6 degrees 40 minutes 40 seconds West 217.94 feet; North 16 degrees 04 minutes 28 seconds West 200.70; North 09 degrees 53 minutes 08 seconds West 87.46 feet and North 18 degrees 29 minutes 45 seconds West 32.79 feet from the Southeast corner of said Section 6; thence from the True Point of Beginning and along said road North 18 degrees 29 minutes 45 seconds West 161.04 feet; thence North 24 degrees 46 minutes 06 seconds East 369.27 feet to a point on the South bank of the Elk River; thence along said bank South 55 degrees 23 minutes 25 seconds East 100.68 feet; thence South 23 degrees 24 minutes 18 seconds West 469.47 feet to the TRUE POINT OF BEGINNING. SUBJECT TO AND TOGETHER WITH a 60 foot wide ingress-egress easement located 30 feet on each side of the West boundary of the above described lot. ALSO SUBJECT TO a 10 foot wide utility easement 5 feet on each side of a line that is 35 feet East of and parallel to the West boundary of the above described lot. INCLUDING a security interest in one (1) 2010 Southern manufactured home, Serial No. DESAL5271AB; together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
