NOTICE OF FORECLOSURE Default having been made in the payment of the indebtedness secured by that certain mortgage dated May 8, 2013, executed by Thomas Sklyer Martin, single man, to Mortgage Electronic Registration Systems, Inc. solely as nominee for Home Mortgage of America, Inc., which mortgage was recorded on May 9, 2013, in RLPY Book 2013, Page 31392 and modified by that certain Loan Modification Agreement recorded February 1, 2016, in RLPY Book 2016, Page 4948, of the mortgage records in the Office of the Judge of Probate of Limestone County, Alabama, which mortgage was, duly transferred and assigned to JPMorgan Chase Bank, National Association, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the West Door entrance to the Limestone County Courthouse at Athens, Alabama, during the legal hours of sale on July 25, 2017, the following described real estate, situated in Limestone County, Alabama, to-wit: 1.76 acres, more or less, lying in the Northeast Quarter of Section 15, Township 3 South, Range 5 West, Limestone County, Alabama and being more particularly described as follows; Commencing at an existing railroad spike at the Southeast corner of the Northeast Quarter of said Section 15; Thence North 01 degrees 26 minutes 07 seconds East along the East boundary of said Section 15 for a distance of 607.11 feet to a point in the approximate center of Reid Road at the Point of Beginning of the herein described property; Thence from the Point of Beginning, leaving the approximate center of Reid Road and also leaving said East boundary, North 89 degrees 17 minutes 30 seconds West for a distance of 350.49 feet to a set 1/2 inch rebar stamped “ATHENS LS CA-0292-LS”, passing a set 1/2 inch rebar stamped “ATHENS LS CA-0292-LS” on the West right-of-way margin of said road at a distance of 30.00 feet; Thence North 01 degrees 26 minutes 07 seconds East for a distance of 218.65 feet to a set 1/2 inch rebar stamped “ATHENS LS CA-0292-LS”, Thence South 89 degrees 17 minutes 30 seconds East for a distance of 350.31 feet to a point in the approximate center of Reid Road on the East boundary of said Section 15, passing an existing 1/2 inch rebar stamped “ATHENS LS CA-0292-LS” on the West right-of-way margin of said road at a distance of 320.51 feet; Thence South 01 degrees 26 minutes 07 seconds West along the approximate center of Reid Road and along the East boundary of said Section 15 for a distance of 218.65 feet to the Point of Beginning, containing 1.76 acres, more or less. AND BEING SUBJECT TO: One half the right-of-way of Reid Road along the East boundary of the above described property, said right-of-way containing 0.15 acres, more or less. This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
